Seoul Central District Court Recognizes Liability for Human Rights Abuses Constituting Crimes Against Humanity

Landmark Ruling Marks First Judicial Recognition of Liability in a Civil Lawsuit Brought by a North Korean-Born Victim Against North Korean Authorities

Min-kyung CHOI and Seung-hyun YOON, Director of the NKDB Center for Human Rights Legal Support, after submitting a civil complaint to the Seoul Central District Court and a criminal complaint to the Seoul Central District Prosecutors' Office on July 11, 2025.
On August 28, 2026 (Friday), the Seoul Central District Court ruled in favor of Min-kyung CHOI, representative of the NK Imprisonment Victims' Family Association (NKIVFA), in a damages lawsuit brought against North Korean authorities.
The Court recognized that, following her forcible repatriation to North Korea in 2008, Ms. CHOI was subjected to inhumane treatment, including sexual abuse, assault, torture, and forced labor at detention facilities including the Onsong County State Security Department, the North Hamgyong Province Holding Center, and the Sunam District Police Office in Chongjin. The Court found the North Korean authorities liable for damages arising from these unlawful acts.
The ruling comes approximately one year after the NKDB Center for Human Rights Legal Support filed the civil lawsuit on Ms. Choi's behalf at the Seoul Central District Court on July 11, 2025. It marks the first case in which a North Korean-born escapee voluntarily brought a civil lawsuit before a South Korean court seeking to hold the North Korean authorities accountable for human rights violations, and the first time the judiciary has recognized such liability in this context.
Min-kyung CHOI stated: "Today's ruling is not a victory for me alone. It is the judiciary's response on behalf of all the victims who have suffered in North Korea's detention facilities. I continue to suffer from severe post-traumatic stress disorder (PTSD), but I hope this ruling will serve as an opportunity to draw greater attention, both in Korea and internationally, to the human rights situation in North Korea."
Seung-hyun YOON, Director of the NKDB Center for Human Rights Legal Support and an attorney, stated: "This landmark ruling affirms the state's responsibility to protect victims of human rights violations in North Korea and provide meaningful redress. But justice is not complete with a judgment—it is only realized when victims receive real compensation. Our Center will stand with victims every step of the way, until justice is delivered."
The NKDB Center for Human Rights Legal Support is a group of public-interest lawyers and experts working to provide remedies and restore the rights of victims of human rights violations committed by North Korean authorities. The Center stands alongside victims until the end to ensure that this ruling serves as a substantive milestone in establishing legal accountability for North Korea's systematic human rights violations.
